Travel Services Terms

Itineraries: Itineraries are subject to change without notice due to, for example, circumstances outside of Indagare Travel’s control.

Insurance: You are responsible for your own travel insurance including medical, travel, and personal belongings. Indagare Travel strongly recommends that each traveler take out a fully comprehensive travel insurance policy. Indagare also strongly recommends that you and each traveler purchase medical evacuation insurance and can assist you in procuring such insurance.

Travel Documentation: It is your responsibility to obtain and pay for all the necessary documentation before traveling (visas, passport, tourist card or any other travel documentation required.) Indagare Travel is not responsible if you or any member in your party does not have all the necessary documentation and therefore cannot enter the country on arrival. Indagare strongly recommends that you and each traveler have passports that are valid beyond 6 months of travel dates as many countries require this. Indagare Travel also strongly recommends that you check with the Embassy or Consulate in your home country before traveling.

Not included in tour rates: Costs of obtaining passports; visas; excess baggage charges; items of purely personal nature, such as drinks, laundry, communication (calls, faxes, emails etc.); international airport departure tax (to be paid in US dollars or acceptable foreign currencies); excursions or deviations from any itinerary or program.

Medical Issues: It is responsibility of every traveler to meet with his or her doctor at least 8 weeks prior to travel to obtain any necessary vaccines or medications. Indagare Travel strongly recommends that you check with the Centers for Disease Control and Prevention for up-to-date, destination specific information related to food and water safety, infectious diseases, and other concerns.

Hotel Booking Requirement: For assistance with trip planning, members are required to book their hotel and resort property stays through Indagare. Indagare has developed special relationships with various hotel and resort properties under which Indagare members receive special treatment such as room upgrades and free or discounted services. In addition, Indagare communicates directly with hotel and resort properties regarding its expectations for the treatment of its members and assists members by communicating with such properties when issues arise.

Fee for Last Minute Trip Planning: Given the labor-intensive nature of last-minute requests due to limited availability, members will be required to pay a late fee during peak seasons as listed below:

• A late fee will be incurred for any travel booked within six (6) weeks of departure date. Non-peak season late fees of $250 apply to any travel booked within four (4) weeks of departure date not within peak season date ranges listed below.
• Peak season late fees of $500 apply to inquiries within 6 weeks of departure dates falling within the following date ranges:
  • 3.15 – 5.1
  • 6.1 – 7.4
  • 12.20 – 1.2

Limitation of Liability and Responsibility: Indagare Travel, and all cooperating carriers and agencies, act only in the capacity of agents for the hotels, airlines, cruise lines, railroads and bus companies or owners or contractors providing accommodations, transportation, guides or other travel or travel related services, (collectively referred to as “Contractors”). All coupons, contracts, exchange orders, receipts and/or tickets issued by Indagare Travel on behalf of such Contractors are subject to any and all tariffs, terms and conditions under which any accommodations, transportation or any other travel or travel related services are provided by such Contractors and/or by their employees or agents. Indagare Travel is not responsible for any negligent or willful act or failure to act of any such Contractors or their employees or agents. In addition, Indagare Travel is not responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any other third party not under its control. Indagare Travel is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation any willful or negligent act, failure to act, breach of contract or violation of local law or regulation by any Contractor or other third party, whether or not it uses the Indagare Travel name. Further, Indagare Travel is not responsible for any loss, injury, death or inconvenience due to delay or changes in schedule, overbooking of accommodation, default, financial default or insolvency of any Contractor or other third party, attacks by animals, injury or death while participating in activities sponsored by Indagare Travel or by a Contractor or other third party, sickness, the lack of appropriate medical care, evacuation to same, if necessary, weather, strikes, acts of God or government, acts of terrorism, or the threat thereof, force majeure, war, quarantine, epidemics, or the threat thereof, criminal activity, or any other cause. You acknowledge that there are inherent and unpredictable risks associated with travel and travel related activities. These risks include but are not limited to loss, injury, death or inconvenience. You expressly assume all risks associated with the travel and travel related services you have arranged through Indagare Travel. You expressly agree that you, your heirs, legal representatives and/or family members will not make a claim against or sue Indagare Travel for any loss, injury, death or inconvenience arising out of such risks. Indagare requires that every person using Indagare travel services agree to the foregoing terms. Since you are the Indagare member arranging for travel services, you agree that it is incumbent upon you to either ensure that each member in your party expressly agrees to these terms in writing or personally indemnify Indagare against any claim brought by any family or non-family member in your party against Indagare for any loss, injury, death or inconvenience arising out of such risks.

Miscellaneous Matters: Baggage is at “owner’s risk” throughout the tour unless insured by the traveler. Indagare Travel reserves the right to alter or cancel any itinerary or portion thereof, at Indagare Travel’s sole discretion, as it may deem necessary or advisable. Indagare Travel reserves the right to decline to accept or retain any traveler on any travel or travel-related activities if, in its sole discretion, it deems accepting or retaining any such passenger as being detrimental to the travel or travel-related activities. In the event any traveler is removed from a trip, Indagare Travel’s only obligation is to refund to that traveler the portion of the payment allocable to unused services. Should you or a member of your party cancel or change your or their air reservations before or after departure, cancellation penalties may apply. All airfares and conditions are subject to change.
All scheduled airline flights are occasionally subject to overbooking, delay or cancellation. If this occurs, Indagare Travel will use its best efforts to assist you and members in your party in finding alternative arrangements. Indagare Travel, however, is not responsible for any such events and the costs associated therewith.

Arbitration: Any and all disputes concerning this contract, any travel or travel related services booked on your behalf by Indagare Travel, and any matter relating to those services shall be resolved solely and exclusively by binding arbitration according to the then current commercial rules of the American Arbitration Association. Any such arbitration will take place in New York City, New York. Any dispute between you and Indagare Travel will be governed by the laws of the State of New York without regard to its conflicts of law rules. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable, and to any dispute regarding travel or travel related services booked on your behalf by Indagare Travel, and any matter relating to those services.
